Abstract: this article reflects on social rights, which are considered fundamental rights and a prerequisite for political integration and empower citizens. therefore, been considered as rights or prerequisites for the exercise of rights, the exclusion from effective access to certain basic services imply a reduction of citizenship as civil and political status. moreover, economic globalization has led to a strong constraint on the state implementation of social policies.

Abstract: Este artículo trata de analizar el conflicto latente en el concepto moderno de ciudadanía desde su origen. Así, si los textos que manifiestan las convicciones de los protagonistas de las revoluciones francesa y norteamericana fundan los derechos humanos en su dignidad como seres humanos libres e iguales (haciendo converger los derechos del hombre en los derechos del ciudadano), una vez inscrita la ciudadanía en las fronteras del Estadonación, el estatus y los derechos correspondientes a los ciudadanos les son atribuidos en tanto que son miembros de un demos definido por ciertos criterios de pertenencia.

Debate en torno al multiculturalismo. Ciudadanía y pluralidad cultural

Abstract: El multiculturalismo -la convivencia en el mismo espacio social de distintos grupos provenientes de diferentes culturas- cuando se aplica en las sociedades contemporáneas suele dar lugar a una serie de difi cultades, en ocasiones problemáticas. El multiculturalismo colisiona con el concepto de ciudadanía en las sociedades contemporáneas, a la vez que supone un intento por redefi nirlo. En efecto, el modelo clásico del estado liberal democrático se basa en un concepto de ciudadanía que abstrae, entre otros, las particularidades culturales y establece la identidad política sobre la condición formal del ciudadano como un ser sujeto a derechos y deberes iguales para todos, lo cual no se ajusta a la realidad de las sociedades plurales y heterogéneas (multinacionales y multiétnicas), donde grupos minoritarios realizan demandas para el reconocimiento de la especifi cidad cultural. Estos grupos exigen derechos y medidas específi cas con el objetivo de preservar la identidad de los individuos ciudadanos y su pleno autodesarrollo. Esto puede ser entendido como una exigencia para ampliar el concepto de ciudadanía (considerando a los ciudadanos no solo como individuos, sino también como miembros de grupos), lo cual resulta difícil de armonizar con los presupuestos subyacentes al modelo liberal democrático clásico de ciudadano. Este artículo plantea este debate, analizando las diferentes alternativas que los diversos modelos de ciudadanía proporcionan a la existencia y al desafío del multiculturalismo.

Abstract: Este artículo centra su reflexión sobre los derechos sociales en el Estado de Bienestar, y plantea la pregunta de si su protección es indispensable para posibilitar la autonomía del ciudadano. Así, partiendo de que la exclusión del acceso efectivo a ciertos servicios básicos implica una reducción de la ciudadaníay de la integración política, considera que la participación ciudadana y la sociedad civil son elementos indispensables para repensar y democratizar un Estado de Bienestar anquilosado burocráticamente, sin que ello suponga un retroceso en las conquistas históricamente alcanzadas.

Abstract: More than fifty yers after Pío Baroja passed away (1956), this paper aims to examine Baroja’s idea of history. Through the personal experiences of his historial but recreated character Eugenio de Aviraneta, the hero of the twenty-two volumes of his Memories of a Man of Action, Baroja explores Spanish history. Moved by an essentially intellectual stimulus, Baroja holds history educates thought, explains the present and anticipates the future. In this journey, that lasts from 1912 to 1934, Baroja makes use of the resources literature enjoys to express thought. The result is a profound reflection, always relativized by his pessimism and his skepticism, on a generation capable of clarifying the meanings of the history of Spain. Coincidiendo, más o menos, con el cincuentenario de la muerte de Pío Baroja (1956), este artículo pretende acercarse al modo con que el escritor se enfrentó al hecho histórico. De la mano de su histórico y recreado pariente Eugenio de Aviraneta, el activista héroe de los veintidós tomos de las Memorias de un hombre de acción , Pío Baroja, animado por un estímulo esencialmente intelectual, se adentra en la historia, entendida como educación del pensamiento que, dice Baroja, explica el presente y predispone para el futuro. En este viaje, que transcurre desde 1912 a 1934, y usando los instrumentos que la literatura posee para expresar el pensamiento, Pío Baroja realiza una profunda reflexión, siempre relativizado por su pesimismo y escepticismo, sobre una generación de la historia de Espa a, capaz de esclarecer lo espa ol.

Identificación con los personajes y persuasión incidental a través de la ficción cinematográfica

Abstract: the identification with the characters is a mechanism that permits the audience experience from inside the narration, as a consequence of an empathetic reaction toward the protagonist. in the present article two empirical studies are included in which the identification with the characters is analyzed in relation with media entertainment, particularly, with reference to reception and impact of features films. in the study 1, we contrasted that the identification with the characters predicted the mood change provoked by viewing a dramatic film stimuli. in a second study, we observed that the identification with the characters was an explicative variable of narrative persuasion, that is, it was responsible of the film impact in attitude and beliefs. the results are consistent with the hypothesis and certificate the theoretical importance and centrality of the identification with the characters construct in the research about the effects of media entertainment and narrative persuasion.

Abstract: The author analyzes the controversial hagiographical sources relative to Prudencio of Armentia, bishop of Tarazona. They're several documents of literary character that narrate Prudencio's life, although certain textual variants don't correspond the mentioned religious figure. In this study the author tries to answer some questions linked to the reliability of these sources: which is the hagiographical value of each of these testimonies in connection with the prelate of Tarazona, how old are they and which way have they been transmitted through the time. La autora analiza las controvertidas fuentes hagiográficas relativas a Prudencio de Armentia, obispo de Tarazona. Son varios los documentos de carácter literario que narran la vida de Prudencio, aunque hay determinadas variantes textuales que no corresponden al citado personaje religioso. En el presente estudio se pretende responder a diversas cuestiones relacionadas con la fiabilidad de estas fuentes: cuál es el valor hagiográfico de cada uno de estos testimonios en relación con el prelado turiasonense, qué antigüedad poseen y cómo se han transmitido a lo largo del tiempo.

La fuerza vinculante del precedente judicial

Abstract: On the one hand, it’s used to be defended the binding character of legal precedent (vertical) as an instrument to safeguard the value of security (and other legal values). But, on the other hand, Constitution establishes the independence of judges “bounded solely to law’s empire”. In this paper I put forward a harmonization of both viewpoints, by recognizing an ‘unconditional’ binding power to law and a binding power of precedent, but ‘conditioned’. Por un lado, se defiende el carácter vinculante del precedente judicial (vertical) como instrumento para asegurar el valor de la seguridad (y otros valores jurídicos). Pero por otro lado, la Constitución establece la independencia de los jueces “sometidos únicamente al imperio de la ley”. En este trabajo, se propone una conciliación de ambas posturas, reconociendo fuerza vinculante ‘incondicionada’ a la ley y fuerza vinculante pero ‘condicionada’ al precedente.
